Mallorca Spanish discrimination Tax refund
Mallorca Legal Action on Discrimination
Each individual should pursue an action to get a tax refund Please
note the point, it is not a matter of simply filing a form with the
tax authorities for the rebate.Urgent Legal intervention is required
to push the tax authorities into compliance and there is for sure a
battle to come. This has prompted a Law firm in Barcelona to file one
of the largest class action law suits ever claimed against tax
authorities for a tax refund for the distressed sellers which has been caused in property or properties
sales through Spain. The places that have been affected like Mallorca in this discrimination act in respect of tax an the taxes which have been taxed in overcharging or incorrectly with held.
This class action law suit consists of approximately 100 plus British
property owners and sellers. Costa, Alverarez, Manglano and
Associates, (CAM&A) the lawyers heading up the class action law suit
stated that it will take time to recover the tax money, approximately two
to five years as court battles are slow and distressed subjects and
time consuming in Spain in respect of tax claims. They feel confident in this tax unfairly withheld on property or
properties and believe in a battle eventually being the winners, since international
EU laws on discrimination has clearly and unequivably been swept
aside. by the government in respect of this tax. Parties affected should start there refund claim now
"Non residents" who sold a property or properties previous to Mid
January 2004 have already missed out as there is a four year statute
of limitation on filing a claim even in Mallorca, meaning that
hundreds of thousands more people have become victim to fraudulent tax
practices and there is nothing much they can do about it in the
Balearics Mallorca.
Would YOU QUALIFY. on this distressed subject. even if you live in Mallorca.
To make a refund claim you must meet the following.
A. sold a Spanish property or properties between May 2004 and December 31st 2006
B. You were NOT a fiscal resident inn Spain when you sold the property
properties
C. You have paid the capital gains tax to the Spanish Authorities even
in Mallorca.
D. You sold your property as an individual not as a company you have
or can obtain a copy of the Spanish tax form 'Modelo 212' that you
completed and filed when you sold the property even on the island of
Mallorca.
So you qualify… now what do you do. even if you live in mallorca
Those who want to try and get this tax rebate will have to pursue legal
action. There is power in numbers. In order to be cost effective, it
is recommended that you join a class action lawsuit. Please remember
you must act quickly. If it takes several years for a ruling and you
do not file now, then statue of limitations will apply and you will no
longer be entitled to the Tax rebate. Perhaps the tax authorities are
hoping for two things:
A. none of this information to be made public
B. the longer they buy time the less people can claim against them.
