The lawyer will ensure that all Spanish legal requirements are met, that the property is registered in the vendor´s name and that it is free of any mortgages, charges, encumbrances, debts or other liabilities. It will also be ensured that all local contributions and community charges are up to date. A Spanish lawyer will also negotiate and discuss the purchase terms with the vendor's lawyer. These terms should not only include the price but should cover in detail all your requirements like the completion date and the form of payment. A purchase option contract is normally drawn up and a reservation deposit paid of 10% of the purchase price. This private contract is signed by both parties and before it is signed, the searches and investigations at the land registry in respect of the property will have been completed. Both parties must also agree on a completion date and this always takes place before a Spanish public Notary.

At the Notary's, the title deeds of the property are signed and you then take possession of your new Spanish home, with the handing over of the keys. Now the sale is completed and immediately after completion, the Notary will fax details of the title deed to the Land Registry to inform them of the identity of the new owner. In this way, the Notary and the Land Registry act together to protect and guarantee your interests. You will then have to pay the relevant taxes and have the original title deed submitted to the land registry for registration.
